MINUTES
THE RIGHTS OF WAY SUBCOMMITTEE
COASTAL RESOURCES MANAGEMENT COUNCIL

DATE: November 23, 2010

TIME: 5:45 p.m.

PLACE: Department of Administration, Conference Room A

PRESENT: Chairman Lemont, member(s) Bruce Dawson and Robert Driscoll, and Legal Counsel Brian Goldman.

AGENDA:

1. Bristol ROW. Legal Counsel updated the members on the ongoing litigation involving Clipper Way in Bristol, and the fact CRMC has been made a party to that litigation.

2. WesterlyROW's.LegalCounseladvisedthesubcommitteehe continues to work with the Attorney General's office researching potential ROW's in Westerly.

3. Howard Wharf ROW, Newport. Legal Counsel and the subcommittee discussed the resolution of the Pier's liquor license on Howard Wharf in Newport. The subcommittee authorized Legal Counsel to end CRMC's involvement in the license appeal. The subcommittee members unanimously agreed that the placement of tables in an area adjacent to the ROW for the period from April 1 - October 31 did not impact the existing ROW. Further, the members agreed that the addition of an additional 5-feet of public access around the tables from April 1 - October 31 as well as the fact the entire area would be open to public access from October 31 - April 1 was an expansion of existing public access. Therefore, it was no longer necessary for CRMC to pursue the liquor license appeal.

There being no other business before the subcommittee, the meeting adjourned at 5:57 p.m.
