THE RIGHTS OF WAY SUBCOMMITTEE
COASTAL RESOURCES MANAGEMENT COUNCIL
DATE: July 26, 2011
TIME: 5:45 p.m.
PLACE: Department of Administration, Conference Room A One Capitol Hill, Providence, RI
PRESENT: Subcommittee Chairman, Lemont, CRMC Chair Livingston, member Dawson and member de Ramel, Executive Director, Grover Fugate and Legal Counsel Brian Goldman.
AGENDA:
1. Westerly Rights-of-Way. Legal Counsel updated the subcommittee on the potential litigation that the Attorney General's office is contemplating in Westerly which involves some potential rights-of-way and a quiet title action to property along the shore. Members de Ramel, and Livingston asked about the background of the matter. There was a general discussion regarding this background by all the members. Legal Counsel then advised the rights-of-way subcommittee that the Attorney General's office was requesting that the CRMC be a co-plaintiff in the lawsuit they intend to commence. Legal Counsel asked for authorization of the subcommittee to be a co-plaintiff in that lawsuit. The subcommittee, on a unanimous vote of Subcommittee Chair Lemont, CRMC Chair Livingston, Member Dawson and Member deRamel authorized legal counsel to participate in that lawsuit on behalf of CRMC when that suit is commenced.
There being no other business to come before the Rights-of-Way subcommittee, the meeting adjourned at 6:00 p.m.
