RI Coastal Resources Management Council

In accordance with notice to members of the Rhode Island Coastal Resources Management Council, a meeting was held on Tuesday, April 14, 2015 at 6:00 p.m. in Conference Room A of the Administration Building, One Capitol Hill, Providence, RI.

1. CALL TO ORDER

Chair Livingston called the meeting to order at 6:00 p.m.

2. APPROVAL OF THE MINUTES OF THE PREVIOUS MEETING

Chair Livingston called for approval of the minutes from the previous meeting. Vice Chair Lemont motioned for approval of minutes from March 24, 2015; seconded by Mr. Coia. Motion carried on unanimous voice vote.

3. STAFF REPORTS

Mr. Fugate informed the Council on the following:

  • Alton Jones Retreat was very successful with 6 members of the Council in attendance as well as CRMC staff with the main part of the discussion revolving around the Beach SAMP.
  • Ocean SAMP Stakeholder meeting inadvertently posted as a Subcommittee Meeting; but not a Subcommittee Meeting. Discussion on regional data gathering
  • Regional Planning Body has received $10 million dollars to do work relative to Ocean planning in the region which will benefit the state to update the Ocean SAMP.
  • Beach SAMP Stakeholder meeting on April 21 at URI Coastal Institute at the Bay Campus – Chris Jones, internationally recognized coastal engineer, will be speaking on coastal engineering practices in the coastal zone.
  • BOEMRE will be in Massachusetts on April 29 to discuss the sale of the leased area for Massachusetts. Mr. Fugate will be attending by invitation from BOEMRE.
  • The May 12th Council meeting will be dedicated to reviewing the final decision for the Deepwater Wind Towers as they have a tentative construction date of July, 2015.
  • Our April 28th meeting will be in Newport.

Mr. Goldman updated the Council on the Attorney General’s lawsuit regarding Westerly ROWs. An adverse judgment was entered which was appealed by the AG’s office and CRMC is assisting in any way they ask.

4. SUBCOMMITTEE REPORTS

None.

5. APPLICATIONS WHICH HAVE BEEN OUT TO NOTICE FOR 30 DAYS AND ARE BEFORE THE FULL COUNCIL FOR DECISION:

2014-12-015 PETER GUMMO -- Construct and maintain a residential boating facility of 125’ by 4’, extending 50 feet beyond mean low water with an “L”-shaped, fixed terminus. Located plat 1, lot 138; 70 Waterway, North Kingstown, RI.

Mr. Fugate briefed the Council on the application stating that the reason the application was before the Council was an objection from the abutting neighbor regarding the location of the dock. Mr. Fugate stated that the two parties (owner and abutter) had reached an agreement which the plans now reflect and the abutting neighbor has removed his objection.

Joseph DeAngelis, Attorney representing Mr. Gummo explained that the dock location will be moved 40’ making it about 100’ from Dr. Sharif’s property line. Mr. DeAngelis asks for approval of revised proposal.

Sean Coffey, Attorney at Burns & Levinson was present representing Dr. Barry Sharif, the neighbor directly to north of Mr. Gummo. Dr. Sharif’s main concern was the impact to his view. Mr. Gummo was very accommodating to Dr. Sharif; and with the new proposal, Dr. Sharif withdrew his objection if new proposal is approved.

Mr. Beaudette and Mr. Gagnon motioned for approval of revised proposal with a second from Vice Chair Lemont. Motion carried on a unanimous voice vote.

6. ENFORCEMENT FILES BEFORE THE FULL COUNCIL FOR REVIEW:

15-0001 MATTHEW AND VIVIAN LaCROIX – Unauthorized construction of riprap retaining wall on a coastal feature and associated back fill. Located at plat N, lot 183; 89 Stanton Avenue; Narragansett, RI.

Mr. Fugate gave a brief overview of the subject violation stating that Joseph DeAngelis, Esq was also representing Mr. and Mrs. LaCroix. Mr. Fugate stated that the LaCroixs agreed to remove the wall with will take care of the violation.

Mr. DeAngelis stated that he was working with Mr. Fugate regarding the Consent Agreement language and that Danni Goulet, CRMC Engineer, had sent him information regarding innovative gabions for erosion protection and it may be something the LaCroixs will look at. Mr. DeAngelis suggested that contractors be informed of CRMC policy as the LaCroixs were approached by a contractor who was working on other location in the area.

No vote was required.

9. ADJOURN

Vice Chair Lemont motioned, seconded by Mr. Coia, to adjourn. Motion carried on unanimous voice vote. Meeting adjourned at 6:19 p.m.
