In accordance with notice to members of the Rhode Island Coastal Resources Management Council, a meeting was held on Tuesday, June 11, 2019 at 6:00 p.m. in Conference Room A, Administration Building, One Capitol Hill, Providence, RI.

1. CALL TO ORDER

Chair Cervenka called the meeting to order at 6:00 p.m.

2. APPROVAL OF THE MINUTES OF THE PREVIOUS MEETING

Chair Cervenka called for approval of minutes:

3. SUBCOMMITTEE REPORTS

No matters to report.

4. STAFF REPORTS

Mr. Fugate updated the Council on the following:

  • Wind Energy in New England
  • NOAA 312 review with a report that will follow within a few months.
  • Town of South Kingstown Phase II of Matunuck Beach Road project.

5. STATUS UPDATE (as required by Council from Decemer 11, 2018):

B1990-08-029 WC COASTAL DEVELOPMENT LLC (previously Melville Associates) – Original assent to: Construct and maintain a 1,495 slip commercial complex, including various marina buildings and facilities, parking, offshore, timber breakwater, dredging, structural shoreline protection, and public access. Assent Modification for Wave Fence. Location of project is plat 43, lots 4, 5 and plat 50, lots 6, 7; west of Burma Road, Portsmouth, RI.

Attorney Joseph DeAngelis addressed the Council stating that the status of the project had not changed and that the new/current owner intended to submit a new application to CRMC for a combination mooring marina and dock. Mr. DeAngelis stated that the Assent through its last extension would expire at the end of the year.

6. APPLICATIONS WHICH HAVE BEEN OUT-TO-NOTICE AND ARE BEFORE THE FULL COUNCIL FOR DECISION:

2019-03-030 QUONSET DEVELOPMENT CORP -- To perform approximately 678,000 cubic yards of maintenance dredging from the approach channels and areas around Piers 1 & 2 at the Quonset Business Park. The material will be disposed offshore at the Rhode Island Sound Disposal Site and has already received its suitability determination from the Army Corps of Engineers/EPA. Located at Piers 1 and 2 and approach channels, West Passage, Quonset Business Park, North Kingstown, RI. Plat 193, lots 015, 026

Mr. Goulet gave a brief overview of the application to the Council stating that the QDC would be performing maintenance dredging of approximately 680,000 cy with the disposal site being in Rhode Island Sound. Mr. Goulet stated that the project had received suitability from Army Corps of Engineers and a Water Quality Certification from RIDEM. Mr. Goulet stated that no objections were received on the application, all applicable standards of the RICRMP had been met, and that CRMC staff recommended approval.

Two other phases of the project had already been approved.

Oyster farm will be moved temporarily and then moved back; Mr. Goulet confirmed that during the dredging season it is a dormant time of the year for oysters.
Pier expansion already approved by the Council

Ed Spinard of the Quonset Development Corporation addressed the Council and thanked the staff for their diligence in their review. Mr. Spinard explained that this project is part of a 50 million dollar bond issued for infrastructure improvement and asked the Council for their consent.

Chair Cervenka opened the comment period, and hearing none, closed the comment period.

Mr. Sahagian motioned for approval with all staff recommendations.

Mr. Gomez seconded the motion stating that the project would significantly benefit RI and cause little to no harm to the environment.

Motion carried on a unanimous voice vote.

7. ENFORCEMENT CASE BEFORE THE COUNCIL FOR AN ORDER TO RESTORE:

17-0106 KRISTAN PETERS HAMLIN AND GEOFFREY HAMLIN -- An order to restore the buffer zone at plat 11, Lot 38 Battery Lane, Jamestown in accordance with the approved restoration plan (“Proposed Buffer Zone Restoration Plan”, dated 10/30/18), and to permanently demarcate the inland edge of the buffer zone.

Mr. Willis addressed the council stating that the agenda item was continued at the request of staff as legal counsel and the Hamlin’s representative are very close to an agreement.

Chair Cervenka stated on the record that if the case comes back before the Council she will recuse herself.
