Notice for USACE Review Process

Any projects that involve work below Mean High Water (MHW) will require an independent federal review via the US Army Corps of Engineers (USACE). CRMC is not responsible for coordinating the review process. As such, Applicants should apply to USACE independently and concurrently with their CRMC Application, as applicable.

Some specific changes for the RI Program:

  • General Permit 4 Activities such as piers, ramps, and floats are no longer eligible as Self Verifications (SVs), even with an Assent from CRMC. Starting on November 20, 2025, applicants for these structures will require a full separate authorization under a USACE Regional General Permit (RG4)
  • Pre-construction Notifications (PCNs) require an official Corps application form, jurisdictional plans and impact calculations, and supporting materials such as a narrative project description, among other requirements, in addition to state applications or public notices.
  • The Regulatory Request System (RRS) shall be utilized when submitting PCNs via https://rrs.usace.army.mil/rrs.
  • Applicants for SVs (only) must coordinate project plans under S.106 with RI HPHC and THPO that are either 1) finalized or 2) draft, but construction means/methods and impact areas will not change before construction. The Corps will coordinate under S.106 for PCN/IP projects.

A new Nationwide Permit will be rolled out in 2026, which will replace some, but not all, of the RI General Permits. Updates on this process can be found on the USACE website.
