Applications that have been Out to Notice and are before the Full Council for Decision:

2003-10-004 HARBOR ISLAND IMPROVEMENT ASSOCIATION— Construct a residential boating facility (Association dock) to consist of a: 4' X 48' fixed timber pier, a 3' X 15' ramp and three (3) floats (4' X 36') totaling 144 square feet. The proposed (Association) dock will extend to 48-feet beyond mean low water (MLW). Located at plat Y-1, lot 238; Wheatfield Cove Road, Narragansett, RI.

2003-04-015 TOWN OF CHARLESTOWN— Construct and maintain a dock to be utilized by the Town Harbormaster and by other Town Public Safety Personnel. The proposed structure is to consist of a 5 foot wide by 70 +/- foot fixed pier with a ramp that leads to a ramp that leads to a150 SF terminal float. The structure will extend 75' +/- seaward of the cited Mean Low Water mark. The applicant also proposes to remove from tidal waters stones from a remnant dock. Located at plat 12, Roadway ROW, Terminus of Town Dock Road, Charlestown, RI.

2003-04-122 EASTERN RESORTS CO., LLC— Expand existing marina, per plan. Construct new seawall/bulkhead seaward of existing deteriorated bulkhead (Approx. 135 linear feet total length). Located at plat 16; lots 158, 139, 143.4; the "Inn at Long Wharf"; 128 Long Wharf, Newport, RI.

2002-10-038 DAVID ROEBUCK— Proposed approximately 3 acre aquaculture farm to grow the American Oyster. Proposed farm will be sited in Point Judith Pond, just to the northeast of Thomas Point and south of Jonathan Island.

2002-03-058 RICHARD AND JOAN JOHNSTON— Construct a three (3) bedroom, single family, dwelling with attached garage and driveway. The proposed dwelling is serviced by a DEM-ISDS approved septic system and Town water supply (see attached plans). The proposed dwelling is located within 25-feet of the most inland coastal feature. Located plat 89, lot 192; Clinton Drive, North Kingstown, RI.

Public Hearing on Changes to the Rhode Island Coastal Resources Management Program and Management Procedures:

Management Procedures: Section 5.12. Permit Extensions Revise Section 5.12 as follows:

Where the Council has issued a permit to undertake an activity in accordance with this Program, said permit shall require such activity licensed or permitted thereunder to be completed within (3) years from the date of issuance unless specifically granted a longer period of time by the Council. Extensions may be granted for good cause demonstrated by the applicant. Additionally, in determining whether to grant an extension, the Council will consider whether there has been a substantial change in the environmental conditions on the site, whether the CRMP has been amended such that the activity would now require variances or special exceptions, or additional variances or special exceptions, and whether the applicant has made a good faith effort to undertake construction of the permitted activity. In the event an applicant or his agents cannot complete said activity within the three (3) year permitted time, unless specifically granted a longer period of time by the Council, the permit shall expire unless the applicant files a timely petition with the Council for a permit extension. the applicant may, prior to the expiration of said time, petition the Council in writing for an extension. Extensions may be granted for projects only if it has been determined by staff that the work accomplished is in compliance with the conditions of approval established by the Council. The Executive Director in his discretion for cause shown may administratively grant an extension for a period of time of up to one (1) year from the expiration date of the permit. In addition, the Council may grant a maximum of three (3) one (1) year extensions. This section shall apply to all assent permit extension requests submitted after enactment of this provision (effective 4/15/2001). However, for projects associated with public infrastructure, the Council may grant extensions for more than one (1) year.

A notification of permit extension shall be mailed to appropriate municipal and state agencies.

Salt Ponds Region Special Area Management Plan

Revise Paragraph (c) of Section 920.1.A.2 as follows:

Section 920.1A.2(c). Co-operatives and other multi-ownership facilities, [of six (6) units or more], or the subdivision of any land within Self-Sustaining Lands, occurring after November 27, 1984, must meet the density requirement of one residential unit per 80,000 square feet.

Relief from this regulation requires a Special Exception as defined in Section 130 of the RICRMP. Lands which were subdivided prior to November 27, 1984, and do not meet the CRMC density requirement as defined in Section 920.A.1, require a Variance as defined in Section 120 of the RICRMP.

Revise Paragraph (c) of Section 920.1.B.2 as follows:

Section 920.1.B.2(c). Co-operatives and other multi-ownership facilities, [of six (6) units or more], or the subdivision of any land within Lands of Critical Concern, occurring after April 12, 1999, must meet the density requirement of one residential unit per 120,000 square feet. Relief from this regulation requires a Special Exception as defined in Section 130 of the RICRMP. Lands which were subdivided prior to April 12, 1999, and do not meet the CRMC density requirement as defined in Section 920.A.1, require a Variance as defined in Section 120 of the RICRMP.

Narrow River Special Area Management Plan

Revise Paragraph (c) of Section 920.1.A.2 as follows:

Section 920.1A.2(c). Co-operatives and other multi-ownership facilities, [of six (6) units or more], or the subdivision of any land within Self-Sustaining Lands, occurring after December 8, 1986, must meet the density requirement of one residential unit per 80,000 square feet. Relief from this regulation requires a Special Exception as defined in Section 130 of the RICRMP. Lands which were subdivided prior to December 8, 1986, and do not meet the CRMC density requirement as defined in Section 920.A.1, require a Variance as defined in Section 120 of the RICRMP.

Revise Paragraph (c) of Section 920.1.B.2 as follows:

Section 920.1.B.2(c). Co-operatives and other multi-ownership facilities, [of six (6) units or more], or the subdivision of any land within Lands of Critical Concern, occurring after April 12, 1999, must meet the density requirement of one residential unit per 120,000 square feet. Relief from this regulation requires a Special Exception as defined in Section 130 of the RICRMP. Lands which were subdivided prior to April 12, 1999, and do not meet the CRMC density requirement as defined in Section 920.A.1, require a Variance as defined in Section 120 of the RICRMP.
