In accordance with notice to members of the Rhode Island Coastal Resources Management Council a meeting was held on Tuesday, February 8, 2005 at 6:00 PM at the Narraganset Bay Commission Boardroom – One Service Road, Providence, RI.

1. Chair Tikoian called the meeting to order at 6:03 P.M.

Chair Tikoian made a brief statement of clarification on the council’s permitting process.

Mr. Coia seconded by Mr. Zarrella moved approval of the January 25, 2005 minutes. The motion was carried on a unanimous voice vote.

2. STAFF REPORTS

Mr. Fugate announced that the Council in conjunction with the Coastal Resources Center published a guide for Public Assess to the Rhode Island Coast. Mr. Fugate stated that the guide is available to Council members.

Mr. Fugate reported that there would be a public workshop on the SAM Plan for Greenwich Bay on February 9th at the Warwick Sewer Authority. Mr. Fugate said after the public workshop, the SAM Plan would go to the Policy and Planning Subcommittee for theirreview, then put out to notice and sent to the full Council for vote.

3. SUBCOMMITTEE REPORTS

Vice Chair Lemont announced that they would be holding the 12th meeting on the Champlin’s Marina application on February 17th and the two additional meetings scheduled for February had been cancelled and they would schedule three meetings for the month of March. Vice Chair Lemont stated that the meetings would be held at the Stedman Center from 3:00 p.m. to 6:45 p.m.

4. Chair Tikoian read through the agenda to see which applicants/attorneys were present.

5. APPLICATIONS WHICH HAVE BEEN OUT TO NOTICE FOR 30 DAYS AND ARE BEFORE THE FULL COUNCIL FOR DECISION:

2003-04-058 RAM POINT MARINA -- Construct 80 LF of timber bulkhead; to alter the marina perimeter limit to accommodate additional dockage which will accommodate 10 additional boats, and to alter the layout of a portion of the existing dockage. Located at plat 64-4, lot 11; William Schmid Drive, South Kingstown, RI.

Eric Shorten, the applicant was present. Mr. Goulet gave council members a brief summary on the application. Mr. Goulet stated that the application was a proposal to expand the marina to add 10 additional boat slips and bring the total number of slips to 170. Mr. Goulet said there would be 800 c.y. of dredge and they would construct a portion of the bulkhead and some of the dredge material would be placed behind the bulkhead and the remainder would be disposed of at the South Kingstown approved disposal site. Chair Tikoian asked how far Bud Browns Farm was from this facility. Mr. Shorten replied approximately 5 miles from the facility. Chair Tikoian asked how much dredge material would be moved off site. Mr. Shorten responded that there would be approximately 170 c.y on site and 643 c.y. disposed off site. Mr. Zarrella asked about the pumpout facilities and the portable facilities. Mr. Shorten stated that they have one fixed pumpout facility and one upland facility, which pumps into the town sewers. Mr. Shekarchi noted that there was no staff objection to the application but asked if they had town approval. Mr. Shorten replied that they do not need local approval but they have DEM and Army Corps permits. Chair Tikoian noted that they do not need local approval for an expansion of a marina. Mr. Sahagian, seconded by Mr. Coia moved approval of the application with all staff stipulations. The motion was carried on a unanimous voice vote.

2004-06-054 LOUIS MARIORENZI and PRISCILLA SZNEKE – Construct modifications to existing residential boating facility by installing a boat lift system. Located at plat 8, lot 271; 84 Bay View Drive, Jamestown, RI.

Priscilla Szneke, the applicant was present. Mr. Anderson gave council members a brief summary on the application. Mr. Anderson stated that the application was a modification to a residential boating facility adding a boatlift on the end of the dock. Mr. Anderson noted that there was a stipulation that there be a dinghy no greater than 10’ on the boatlift. Mr. Anderson said staff had no objections to the application. Mr. Gray stated that this area was well populated with SUV. Mr. Anderson said yes. Mr. Gray asked what the impact of a jet ski would have at mean low water to the SUV. Mr. Anderson replied that the staff biologist was somewhat concerned with this but the limited size of the vessel and reduced to a non-motorized dinghy would not impact the area. Mr. Gray said the SUV would be protected. Mr. Fugate noted that there was a stipulation that the jet ski would be used off the terminal portion of the float. Mr. Zarrella, seconded by Mr. Coia moved approval of the application with all staff stipulations. The motion was carried on a unanimous voice vote.

2004-09-087 MAUREEN S. LYNCH – Construct and maintain a residential boating facility consisting of a 4’ x 30’ fixed pier and four tie-off pilings, existing -26’ seaward of MLW. Located at plat 1, lot 66; 828 West Beach Road, Charlestown, RI.

Maureen Lynch, the applicant was present. Herb Sirois, the applicant’s engineer was also present on behalf of the applicant. Mr. Anderson gave council members a brief summary on the application. Mr. Anderson stated that the application was for a dock and a 3”’ depth variance was needed. Mr. Anderson said the applicant did not have 18” of water at the terminus of the dock and only had 15” of water at the end. Mr. Anderson stated that the applicant needed a 3” variance to the depth. Mr. Anderson stated that there were no staff objections to the application. Mr. Sahagian noted that they would have approved the application at the dock subcommittee but they could not approve the application because the applicant did not have 18” of water at end of the dock. Mr. Sahagian said the applicant could have lengthened the dock but did not ask for the additional dock length. Mr. Gray asked if the side yard variances had been addressed. Chair replied that they had received letters of no objections from the abutters. Mr. Sahagian, seconded by Mr. Zarrella moved approval of the application with all staff stipulations. Chair Tikoian noted that there was a lettersin the file that was not signed but that they had received a signed copy faxed today. The motion was carried on a unanimous voice vote.

2004-10-121 RIDEM/MUSEUM OF YACHTING – Maintain “as built” marina in Fort Adams basin area. The basin marina is used “almost exclusively for displaying the museum’s collection of classic yachts as in-the-water exhibits.” Other vessels are allowed temporarily into the basin for special events. No space is leased or rented to the public or for non-museum owned boats. Located at Fort Adams, North end, Newport, RI.

David Brown, of the Museum of Yachting was present on behalf of the applicant. Mr. Anderson gave council members a brief summary on the application. Mr. Anderson stated that the application was to legalize an “as built” floating dock assembly in Fort Adams Park which was used for displaying yacht vessels. Mr. Anderson noted that there were no staff objections to the application. Mr. Gray stated that he had no objection to the application but wanted clarification that if the application was approved as a marina permit and staff said this was not a marina and the applicant wanted to sell off the property, what was the language for this. Chair Tikoian replied that this was addressed by a staff addendum to the stipulations. Mr. Brown also replied that they agreed to the staff stipulations and the addendum stipulation. Director Vincent stated that RI DEM was the owner of the property and did not foresee the selling of the property. Mr. Gray, seconded by Mr. Coia moved approval of the application with all staff stipulations and the staff addendum stipulation. The motion carried. Director Vincent abstained.

2004-10-068 BREWER COVE HAVEN MARINA – Perform improvement dredging of approximately 12,500 cy of material, expansion of marina perimeter to the north and west that will increase boat count by 93 for total of 359 slips. Located at plat 01 and 13; lots 51, 2, 3, and 4; located at 101 Narragansett Avenue, Barrington, RI.

Michael Keyworth, Vice President and General Manager of Brewer Cove Haven Marina was present on behalf of the applicant. Sean Coffey, the applicant’s attorney and John Paul Garcia, the applicant’s engineer were also present on behalf of the applicant. Mr. Goulet gave council members a brief summary on the application. Mr. Goulet stated that the application was an expansion to an existing marina perimeter to 93 slips and that there would be 12,400 c.y. of dredging. Mr. Goulet said there were no staff engineering objection or staff biologist objection t the application. Mr. Goulet stated that there was no measurable standard for a Category B on the limit. Mr. Coffey explained that this was improvement dredging and expansion of the marina perimeter to increase the number of slips. Mr. Coffey said this was type 3 waters and there was high boating activity in this area. Mr. Coffey noted that there was no staff objection to the application. Mr. Coffey said they have a letter of support for the application from Save the Bay. Mr. Keyworth stated that he has been involved with the marina for 18 years and gave council members a history of the marina operations. Mr. Keyworth said they are currently doing maintenance dredging and are 90% finished. Mr. Keyworth also described the current dredging project. Mr. Keyworth said the existing dock was 18-20 feet from the federal channel. He said this would be an expansion of the marina perimeter line adding 93 slips for a total of 359 slips. Mr. Keyworth said the need for the expansion was to address the shortage of slips issue. Mr. Keyworth stated that there is a backlog of 2000 slips in Rhode Island according to a survey. Mr. Keyworth explained that they have four (4) fixed pumpout stations and two (2) portable pumpouts. He said they are sewered. He also said they have adequate parking more than double what they need. Chair Tikoian asked if they had a list of names for people who need dock space. Mr. Keyworth replied yes but noted that some people are on a couple of lists. Mr. Keyworth said they have about 100-150 people on their wait list. Mr. Zarrella said there was a shortage of 2000 slips in Rhode Island. Mr. Keyworth replied as far as data available three (3) years ago. Mr. Zarrella asked about the history of the pumpouts and when they were put in. Mr. Keyworth replied they put the first pumpout station in 1991 and have added more pumpouts since then. Chair Tikoian asked about the fire prevention at the marina and asked what measures they were taking to address this. Mr. Keyworth explained that they are currently under the NFPA standards and have to have fire extinguishers every 75 feet and the extinguishers are checked yearly. Mr. Keyworth said since the nightclub fire there have been new regulations and they have two fire hydrants on the property. Chair Tikoian noted that the fire codes were not part of the CRMC regulations but wanted to work with the Rhode Island Marine Trade Association on this issue. Mr. Keyworth agreed. Vice Chair Lemont, seconded by Mr. Zarrella moved approval of the application with all staff stipulations. Mr. Zarrella felt the application was a model for marina expansions with four pumpout stations. Mr. Zarrella was in support of the application. The motion was carried on a unanimous voice vote.

6. APPLICATIONS REQUESTING EXTENSION OF ASSENT BEFORE THE FULLCOUNCIL FOR DECISION:

1999-08-084 NATALE PELLEGRINO REVOCABLE TRUST – Extension of previously approved permit to construct two bedroom single family dwelling with associated decks, elevated dune walkover structure and DEM approved ISDS. Located at plat 156, lot 4, Atlantic Avenue, Westerly, RI.

The applicant was not present. Chair Tikoian continued the application.
