Applications which have been Out to Notice for 30 days and are before the Full Council for Decision:

2005-03-097 TOWN OF BARRINGTON – Construct and maintain a transient boat dock adjacent to the existing public boat ramp located at the former Barrington Police Station property. The proposed structure is to extend approximately 46 feet seaward of the cited Mean Low Water mark. Located at plat 25, lot 3; 95 County Road, Barrington, RI.

2002-10-045 QUONSET DEVELOPMENT CORPORATION – Designate a Public Access Plan for all of Quonset Davisville Port and Commerce Park in North Kingstown. Located at plat 179, lot 22; Off Circuit Drive, North Kingstown, RI.

2005-01-029 MATTHEW & JEANMARIE LEONARD – A residential boating facility consisting of a 4’ x 10’ access ramp, a 4’ x 28’ fixed timber pier with a ramp that leads to a 150 s.f. terminal float. The facility is to extend 33 feet seaward of the cited mean low water mark. The project lies within 10 feet of the northern property line extension and therefore a variance to RICRMC standards is required. Located at plat 87-2, lot 124; 68 Potter Road, South Kingstown, RI.

2003-03-035 MARCIA GLASSIE – Construct a residential boating facility to consist of a 4’ x 151’ fixed timber pier with a lower 4’ x 20’ “L” section at the seaward end of the dock. The terminus of the dock will extend to 74’ beyond mean low water (MLW). Located at plat 9, lot 296; Conanicut Island, 7 High Street, Jamestown, RI.

Dredging and Dredged Materials Disposal

B. Policies

Add new:

7. The Council may require Performance Assurance Bonds for projects that utilize in-water disposal or transit federal channels with loaded scows.

C. Prerequisites

Revise:

2. Except for direct federal activities consistency reviews, applicants for dredging or open waters disposal of dredged materials shall be required to obtain a Dredging Permit (which contains the Section 401 (Clean Water Act) Water Quality Certification) from the Department of Environmental Management (DEM) before the Council can consider granting approval for the project. The application for the Section 401 Water Quality Certification will be forwarded to the DEM when all appropriate application forms have been completed.

F. Standards

Add New:

1.(e) All dredging at any marina shall be bounded to the footprint of the Marina Perimeter Limit (MPL). Side slopes associated with such dredging shall be allowed to extend beyond the MPL and then only when all adjacent structures are not impacted.

Revise:

2. For dredged materials disposal in open water:

(a) - (c) ***

(d) Following disposal operations involving polluted materials, clean coarse-grained materials must may be required to be deposited to cap the spoil mound and minimize the release of any potential contaminants to the water column. The cap shall have a minimum thickness of 6 inches.

(e) The applicant shall provide for an environmental monitoring program designed to detail physical conditions and biological activity at and near the site for a period of at least one year. The results of such programs shall be made public. This shall not apply to disposal into the CAD cell. However, if the monitoring of the disposal of dredged materials at a site is to be performed by, and/or in conjunction with, a state or federally-sponsored monitoring program, then the applicant shall adhere to the requirements of such state-or-federally-sponsored program.

Freshwater Wetlands in the Vicinity of the Coast

A. A Council Assent is required for any project or activity which may alter the character of any freshwater wetland in the vicinity of the coast. Applicants are referred to the CRMC’s Rules and Regulations for the Protection and Management of Freshwater Wetlands in the Vicinity of the Coast for specific programmatic requirements.

Prerequisites

A. A water quality certificate from the Department of Environmental Management shall be a prerequisite for any application to alter pursuant to section 9.05 of the aforementioned rules and regulations.

Management Procedures

Add New Section 5.1(11):

(11) Low and Moderate Income Housing

Low and moderate income housing project applications (ref. RIGL 45-53) received by the Council that seek the preferred status afforded under the Department of Administration’s regulations that implement said statute shall include a letter from the affected community noting clearly that said community has an approved affordable housing plan and that said application is therefore seeking said preferred status.
