THE RIGHTS OF WAY SUBCOMMITTEE
COASTAL RESOURCES MANAGEMENT COUNCIL

DATE: November 24, 2009

TIME: 5:45 p.m.

PLACE: 2nd Floor Conference Room of the Department of Administration Building, 1 Capitol Hill, Providence, RI

PRESENT: Subcommittee Chairman Paul Lemont, Member Bruce Dawson, and Assistant Legal Counsel John Longo.

AGENDA:

The Subcommittee reviewed a Memo from Brian Goldman, Legal Counsel, titled “Rocky Hollow ROW, East Greenwich” and discussed what to do about an apparent encroachment on the Rocky Hollow Right of Way by a marina operation sometimes known as ‘Harris Marina.’ Chairman Lemont explained it had come to the Council’s attention that the marina may not have a CRMC permit and one of its buildings may be partial in the ROW. He also said it appears the Town of East Greenwich had not yet responded to a request for a written statement regarding its position on the issue. After a motion duly made by Bruce Dawson, it was unanimously voted to “refer the question of the legality of the in-water marina facilities to the Full Council for enforcement and/or a removal order in the event Harris Marina can not demonstrate it has received an approval from the appropriate authority.”

There being no other business to discuss, the Rights of Way Subcommittee then adjourned at approximately 5:51 PM.
