In accordance with notice to members of the Rhode Island Coastal Resources Management Council, a meeting was held on Tuesday, September 13, 2011 at 6:00 p.m. in Conference Room A of the Administration Building, One Capitol Hill, Providence, RI.

1. CALL TO ORDER

Chair Livingston called the meeting to order at 6:00 p.m.

2. APPROVAL OF THE MINUTES OF THE PREVIOUS MEETING

Chair Livingston called for approval of the minutes from the August 23, 2011 meeting. Vice Chair Lemont motioned, seconded by Mr. Gomez, for approval of minutes. Motion carried on unanimous voice vote.

3. SUBCOMMITTEE REPORTS

Vice Chair Lemont stated that the Planning and Procedure Subcommittee met on July 27th and is seeking concurrence to begin rule making on RICRMP Section 300.6 – Treatment of Sewage and Stormwater to revise the definition of development, address roadway projects and single-family residential projects with editorial revisions throughout. Chair Livingston accepted for formal rule making.

4. STAFF REPORTS

Mr. Fugate informed the Council that the “Call”, the first step in the Federal leasing process for the wind farms in federal waters is in effect and will close in Rhode Island the first week in October. Mr. Fugate stated that BOEHMRE would be holding a public meeting on September 19th at 6:00 p.m. in the Corless Auditorium at the URI Bay Campus as a public information and comment meeting which will start the EA process. Mr. Fugate informed the Council that the BOEHMRE is starting to hold meetings with other groups such as the Tribes, environmental groups, fishery groups, OSAMP research community. Mr. Fugate stated that Deepwater Wind, RI has been going through the process for a project within State waters trying to determine types of studies necessary and what the parameters would be. Mr. Fugate stated that Deepwater had been conducting many studies for several years and anticipated submitting their application sometime in January for 5 wind turbines of 6 megawatts each.

Mr. Fugate updated the Council on CRMC’s involvement during and after Hurricane Irene stating that there was no substantial damage done to shoreline or structures and that a permitting process was put into effect regarding Maintenance for Storm damage.

Mr. Fugate also informed the Council that CRMC is involved by application processing in a “This Old House” project. Mr. Fugate stated that he would be meeting with them and talking about RI coast and regulatory procedure.

Chair Livingston took applicant’s attendance to see who was present for each application and Mr. Fugate made and opening statement regarding the proceedings and the Assent receipt process.

5. APPLICATIONS WHICH HAVE BEEN OUT TO NOTICE FOR 30 DAYS AND ARE BEFORE THE FULL COUNCIL FOR DECISION:

2011-06-004 TOWN OF NORTH KINGSTOWN – To install additional floats and to establish a Marina Perimeter Limit (MPL) at the Town Dock in Wickford. Located at plat 117, lot 257; Main Street, North Kingstown, RI.

Mark Napp, Harbor Clerk, was present to represent the Town. Mr. Napp was sworn in. Mr. Reis gave a brief overview of the project stating that the Town of North Kingstown was requesting to modify an existing floating dock to accommodate police and fire boats, to add an additional float to end of existing docks and to expand the marina perimeter limit around the facility; along with the relocation of an existing upweller. Mr. Reis stated that the application was reviewed by the staff marina infrastructure coordinator and the staff aquaculture coordinator and both recommended approval of the project. Mr. Dawson motioned, seconded by Vice Chair Lemont, for approval of application. Motion carried on a unanimous voice vote.

2011-03-043 KENNETH PALUMBO -- Construct and maintain: a residential boating facility consisting of a 4’ x 70’ fixed timber pier, 3’ x 20’ ramp, and a 10’ x 15’ float. The facility will extend 75’ beyond Mean Low Water to a water depth of -4’ (MLW). A 25’ variance is required to the 50’ standard length beyond MLW (ref. RICRMP 300.4.E.3.l(2)) is required. Located at plat 17, lot 41; 47 Shore Drive, Warren, RI.

Kenneth Palumbo, owner, was present. Mr. Reis gave a brief overview of the project stating that the project consisted on construction of a residential boating facility to extend 75-feet beyond MLW to a depth of -4’ in the Kickemuit River. Mr. Reis stated that the application required a 25’ length variance and a .2’ variance for height over the wetland. Mr. Reis stated that staff had no objections to the application but that there was one objection from the Warren Conservation Commission objecting to the length. Mr. Reis stated that the facility will not extend further than any of the other docks located in the vicinity. Vice Chair Lemont motioned, seconded by Mr. Hudner, for approval of the application. Mr. Dawson asked Mr. Palumbo about the number of boats he would be keeping at the dock and expressed concern regarding CRMC’s four boat allowance. Mr. Palumbo was sworn in and stated that he would be keeping at least three boats if not four at the dock. The Council discussed revisiting the four boat maximum allowance at a Policy and Planning Subcommittee meeting. Vice Chair Lemont’s motion carried on a unanimous voice vote.

7. ADJOURN

Mr. Affigne motioned, seconded by Mr. deRamel, to adjourn. Motion carried on unanimous voice vote. Meeting adjourned at 6:37 p.m.
