RI Coastal Resources Management Council

In accordance with notice to members of the Rhode Island Coastal Resources Management Council, a meeting was held on Tuesday, September 23, 2014 at 6:00 p.m. in Conference Room A, Administration Building, One Capitol Hill, Providence, RI.

1. CALL TO ORDER

Chair Lemont called the meeting to order at 6:00 p.m.

2. APPROVAL OF THE MINUTES OF THE PREVIOUS MEETING

Vice Chair Lemont motioned, seconded by Mr. Hudner, for the approval of the minutes from the last meeting of September 9, 2014. Motion carried on a unanimous voice vote.

3. SUBCOMMITTEE REPORTS

Vice Chair Lemont read out revisions to the RI CRMP Section 210.3 which had been approved by the P & P Subcommittee at the September 16th meeting. Chair Livingston stated that the revisions would go out to public notice.

4. STAFF REPORTS

Mr. Goldman reported to the Council on ongoing Deepwater Wind litigation. Chair Livingston to sign the CVA Agreement.

5. ENFORCEMENT MATTER BEFORE THE FULL COUNCIL:

10-0029 BEACHVIEW PARTNERSHIP, LLC – Unauthorized structural shoreline protection located at plat 92-3, lot 7; 921A Matunuck Beach Road, South Kingstown, RI.

Mr. Fugate explained that the property owners engaged legal counsel, Turner Scott, Esq., and that he asked for a continuance for his clients so they could look at experimental regulation and potentially submit a request under the emergency regulations. Mr. Fugate informed the Council that Mr. Scott also raised an issue as to the notice of violation. Mr. Fugate stated that another notice of violation was issued and that the CRMC has given them 25 days to submit an application, otherwise it will be scheduled to come before the Council, which would be November 25th.

6. EXECUTIVE SESSION

Chair Livingston announced that the Council would go into Executive Session. Vice Chair Lemont motioned, seconded by Mr. Hudner, to enter into an Executive Session. Mr. Goldman took a roll call vote in which the motion was carried unanimously by all in attendance. Mr. Goldman stated that he and Mr. Carlotto would talk with the Council members about some Deepwater Wind lease issues.

The Council came out of Executive Session at 7:40 p.m. No votes were taken during the Executive Session

8. ADJOURN

Vice Chair Lemont motioned, seconded by Mr. Gomez, to adjourn. Motion carried on a unanimous voice vote. Meeting adjourned at 7:41 p.m.
