RI Coastal Resources Management Council

In accordance with notice to members of the Rhode Island Coastal Resources Management Council’s Planning and Procedures subcommittee, a meeting of the subcommittee was held on Tuesday, November 18, 2014 at the offices of the CRMC, Stedman Government Center, 4808 Tower Hill Rd, Wakefield, RI.

Call to Order. Ms. Livingston called the meeting to order at 8:32 a.m.

Ms. Livingston called for a motion to approve the minutes of the September 16, 2014 subcommittee meetings.

Mr. Gomez seconded by Mr. Liberti moved to approve the meeting minutes of September 16, 2014. All voted in favor of the motion.

Item 4.A. and 4.B – Section 400 Federal Consistency and Federal Consistency Manual. G. Fugate presented the need to update the Federal Consistency Manual generally and in specific the listed activities tables for direct federal activities, federal license or permit activities, and federal financial assistance. Staff would begin its research of the listed activities found in the other New England/New York/New Jersey states programs. Additionally, staff will be looking at NDI (Necessary Data & Information) for such as well as looking at OSAMP policies and listed activities for incorporation, updating and revision. Lastly staff will research and work with NOAA’s federal consistency coordinator to address and properly incorporate NDI as applicable. B. Goldman explained the difference of state regulatory jurisdiction v. federal activities in state waters. G. Fugate explained how federal agencies are required to be notified when making revisions to the list of federal activities. Both Ms. Livingston and Mr. Gomez questioned the potential need for this work to be done via outside assistance. G. Fugate explained that staff can handle the revisions to the list of federal activities and that staff and legal counsel will need to spend some time on how best to address the incorporation of policy revisions into the program vis-à-vis federal consistency provisions generally and NDI specifically. B. Goldman explained that should any of this work result in proposed changes to Section 400 that said revisions will undergo state regulatory rule-making.

The chair directed staff to undertake the work required to make revisions to both Section 400 and the Federal Consistency Manual as needed for future consideration by the subcommittee.

ADJOURNMENT. Mr. Lemont, seconded by Mr. Gomez, moved to adjourn the subcommittee meeting. All voted in favor of the motion and the meeting was adjourned at 9:22 a.m.
