In accordance with notice to members of the Rhode Island Coastal Resources Management Council’s Planning & Procedures subcommittee, a meeting was held on Tuesday, March 21, 2017 at 8:30am at the offices of the CRMC, Stedman Government Center, 4808 Tower Hill Rd, Wakefield, RI.

Call to Order. Ms. Livingston called the meeting to order at 8:35 a.m.

Ms. Livingston called for a motion to approve the minutes of the January 17, 2017 subcommittee meeting.

Ms. Montanaro seconded by Mr. Liberti moved to approve the meeting minutes of January 17, 2017. All voted in favor of the motion.

Item 4.A – Revise Section 300.4 Recreational Boating Facilities. J. Boyd explained proposed revisions. He explained the new revision format and that the RICRMP excepting for this section and the aquaculture section has been reformatted for the new state requirement. He explained that the aquaculture section will be ready for the subcommittee’s review at its next meeting. This section will become Section 1.3.1.D under the new formatting requirements. J. Boyd explained that the proposed revisions were mainly taken from the Pre-Existing Residential Boating Facilities Program, which will be repealed under the new state formatting requirements yet still contained several programmatic policies and standards that are now proposed for inclusion herein. One new proposed addition is to clarify how the regulations look at shared docks, a primary policy focus of the existing regulations. J. Boyd and G. Fugate explained the clarified regulations for shared docks. Ms. Montanaro asked about essentially dilapidated residential docks in Type 1 Waters; can they be rebuilt given the existence of adjacent docks in said water type. G. Fugate explained how they cannot and how the existing such docks can remain under the functionally intact and continuous use allowance. G. Fugate explained the genesis of the Pre-Existing Residential Boating Facilities Program for context. Mr. Liberti asked about the term “issue our own Assents” found in B.8. G. Fugate explained the travel of the use of the term “Assent” from agencies that pre-dated the CRMC and that the use of the phrase “issue our own Assents” was to provide a consistent understanding that Assents from other agencies may persist and this proposed regulation was not only recognizing that use but also its differentiation in its use by the CRMC. Mr. Liberti asked about the proposed prohibition at D.9 noting the difference between terminal floats and floats in general and that there appears to be a need to call-out floats that are terminal floats. Staff agreed and the subcommittee made the change.

Mr. Gomez seconded by Mr. Liberti moved to approve the proposed regulations as revised and begin rule-making. All voted in favor of the motion.

ADJOURNMENT. Mr. Gomez, seconded by Mr. Liberti, moved to adjourn the subcommittee meeting. All voted in favor of the motion and the meeting was adjourned at 9:20a.m.
