RI Coastal Resources Management Council

In accordance with notice to members of the Rhode Island Coastal Resources Management Council’s Planning & Procedures subcommittee, a meeting was held on Tuesday, June 12, 2018 at 4:30pm at the offices of the CRMC, Stedman Government Center, 4808 Tower Hill Rd, Wakefield, RI.

Call to Order. Ms. Cervenka called the meeting to order at 4:30 p.m.

Item 4.A – Revise 650-RICR-20-00-1.1.6(I) –Applications for Category A and Category B Assents. J. Boyd explained the revisions proposed to the section that pertain to Chapter five of the Beach SAMP. G. Fugate explained the threshold activities that would invoke a requirement for applications to use a Chapter five analysis for their applications, as well as having the application’s staff report registered on Title. Ms. Cervenka stated that this requirement will have applicants’ actively deliberate future conditions and scenarios for their projects. Ms. Reynolds noted how design life of a project needs to mesh and be aware of finance timeframes.

Mr. Gomez, seconded by Ms. Reynolds, moved to begin rule-making. All voted in favor of the motion.

Item 4.B – Revise 650-RICR-20-00-1.3.1(C) – Residential, Commercial, Industrial & Recreational Structures. J. Boyd explained the revisions to the proposed section to codify the Fitness for Purpose requirements into this specific section as well as reiterating what the requirements accomplish programmatically.

Mr. Gomez, seconded by Ms. Reynolds, moved to begin rule-making. All voted in favor of the motion.

Item 4.C – Revise 650-RICR-20-00-1.3.1(D) – Recreational Boating Facilities. J. Boyd explained the revisions to the proposed section to add a certification of dock construction according to the approved plans post construction.

Mr. Gomez, seconded by Ms. Reynolds, moved to begin rule-making. All voted in favor of the motion.

Item 4.D – Revise 650-RICR-20-00-1.3.1(H) – Energy Related Activities and Strutures. G. Fugate explained the revisions to the proposed section to add a certification verification agent requirement for certain energy-related activities, modeled on the same for the recent BIWF project and process, as the expertise to review, understand and anticipate issues doesn’t exist within the agency. He explained that the CVA provides an objective 3rd-party analysis that would report to the Council. Mr. Gomez asked at what point or size project is this requirement triggered? G. Fugate stated that at his discretion (ie: when no expertise exists within agency) and for projects that generate 40MW or greater. G. Fugate explained that the standard would be when outside the scope of the Agency’s expertise.

Mr. Gomez, seconded by Ms. Reynolds, moved to begin rule-making. All voted in favor of the motion.

Item 4.E – Revise 650-RICR-20-00-1.3.1(I) – Dredging & Dredged Material Disposal. J. Boyd explained that the revisions to the proposed section are primarily housekeeping in nature to meet ORR requirements for regulation formatting and structure. To this point the prerequisites were removed. Ms. Cervenka asked if these were removed do we then issue Conditional permits. G. Fugate and Mr. Gagnon answered affirmatively and explained the joint notice, review and issuance process currently in place. J. Boyd also noted the addition of standards for CAD Cells and monitoring requirements.

Mr. Gomez, seconded by Ms. Reynolds, moved to begin rule-making. All voted in favor of the motion.

ADJOURNMENT. Mr. Gomez, seconded by Ms. Reynolds, moved to adjourn the subcommittee meeting. All voted in favor of the motion and the meeting was adjourned at 5:14 p.m.
