RI Coastal Resources Management Council

In accordance with notice of the Rhode Island Coastal Resources Management Council’s Planning & Procedures subcommittee, a meeting was held on Tuesday, July 28, 2020 at 4:00 p.m. utilizing the Zoom Platform. All listed members and staff were present on Zoom.

Call to Order. Mr. Gomez called the meeting to order at 4:00 p.m.

Mr. Gomez called for a motion to approve the minutes of the June 23, 2020 subcommittee meeting.

Ms. Reynolds seconded by Ms. Montanaro moved to approve the meeting minutes of June 23, 2020. All voted in favor of the motion.

Item 4.A – Management Procedures 650-RICR-10-00-1 - Amend § 1.4.6(a) Applications for Council Assent/Fees by revising § 1.4.6(A)(22) and adding new § 1.4.6(A)(26). J. Willis and J. Boyd explained the revised fee schedules, firstly the waiver of an application fee for the use of dredged material disposal options for a non-federal (ie: local) CRMC application associated with an ACOE federal navigation project and approved as such by the ACOE. Secondly, the waiver of an application fee for coastal hazard resiliency projects, including but not limited to flood proofing, elevating structures, and other accepted methods, in association with Army Corps of Engineers funded projects was explained.

Ms. Reynolds seconded by Ms. Montanaro moved to approve the fee schedule revisions as presented. All voted in favor of the motion.

Item 5.A – Petition for Declaratory Ruling: “The Applicability of a Water Type 3 Classification in Jamestown” by the Petitioner, The Dumplings Association, LLC. J. Boyd introduced the travel and issue of the request from the Petitioner, The Dumplings Association, LLC, in that the Petitioner is seeking a Council finding as to whether the Council’s designation of Type 3 High Intensity Boating waters for a specified segment of the Jamestown shoreline was better designated as either Type 1 Conservation or Type 2 Low Intensity Use. J. Boyd explained that the Petitioner’s claim is in part based on the nature of the existing shoreline and local zoning requirements. J. Boyd and J. Willis explained the Council’s policies for Types 1 Conservation, Type 2 Low Intensity Use, and Type 3 High Intensity Boating water designations. J. Boyd noted that the Petitioners have not specifically requested the Council to reclassify this particular shoreline segment as a rule change; rather they have requested the Council’s determination as to whether this shoreline segment is appropriately classified. A. Desisto explained the Declaratory Ruling process in that the Council would need to act on the request within 60 days of receipt.

Ms. Reynolds seconded by Ms. Montanaro moved to send the petition to the full Council for review and consideration at a public hearing within the 60 day required period. All voted in favor of the motion.

ADJOURNMENT. Ms. Montanaro, seconded by Ms. Reynolds, moved to adjourn. All voted in favor of the motion and the meeting was adjourned at 4:31 p.m.
