RI Coastal Resources Management Council

In accordance with notice to member of the Rhode Island Coastal Resources Management Council, a virtual meeting was held on Tuesday, July 27, 2021 at 6:00 p.m. located in Conference Room A, of the Administration Building, One Capitol Hill, Providence, RI.

1. CALL TO ORDER

Chair Coia called the meeting to order at 6:03 p.m.

Thank you to members and staff for great job for keeping applications going and meetings going.

Chair Coia recognized Council Members and Staff as present.

2. APPROVAL OF THE MINUTES OF THE PREVIOUS MEETING

Chair Coia called for a motion regarding the minutes for the June 22, 2021 Semi-monthly Meeting.

Motion: Mr. Sahagian
Second: Ms. Reynolds

Motion carried on a unanimous voice vote to approve the minutes from June 22, 2021 meeting as amended.

3. Subcommittee Reports

5. Staff Reports

Mr. Willis addressed the Council on the following matters:

  • Wind farm applications --by Labor Day we will have three active wind farm applications before the Council with James Boyd heading the Wind Team for the reviews
    • Revolution Wind
    • Vineyard Wind (2nd – CT)
    • Sunrise Wind (NY)
  • Bay SAMP Planning Aquaculture Element
    • Working group established to look at the regulatory process of Aquaculture
    • Email Listserv for aquaculture notifications established as immediate result of working group
  • Outreach Program for Public Access workshops headed by Laura Dwyer

6. REQUEST BEFORE THE COUNCIL FOR FOURTH AND FINAL EXTENSION:

2013-08-093 EASTERN ESTATES, LLC & S F PACIFIC, LLC -- Extension of assent to reconstruct and rehabilitate existing buildings on-site and install additional landscape areas, including water features; construction of new conservatory building; additionally, stormwater conveyance and treatment structures will be installed. Located at plat 37, lots 013,102, 108; 570, 580, & 590 Bellevue Avenue, Newport, RI.

Mr. Willis gave a brief overview of the request stating that the applicant was requesting their fourth and final extension. Mr. Willis explained that as part of the extension process, CRMC staff must check for assent compliance and that there were no issues found on site during compliance inspection. Mr. Willis stated that approval of the extension was recommended.

Mr. Regan addressed the Council stating that the assent was for the restoration and reconstruction of the landscape and historic structures of the Beachwood Estate in Newport after acquiring the remaining land parcels associated with the original estate. Mr. Regan stated that they were making tremendous progress on the landscaping restoration which included removal of contaminated soils and replacing with 9 acres of good soils. Mr. Regan stated that landscaping within the CRMC jurisdiction would be completed by December.

There were no question from the Council to the applicant.

Mr. Sahagian motioned to approve the 1 year extension with a second from Mr. Gagnon.

Motion carried on a unanimous vote for the approval of the fourth and final one year extension.

6. REVIEW AND ACTION OF REQUEST FOR DESIGNATION OF RIGHTS-OF-WAY

2020-07-103 PUBLIC STREET – CITY OF PROVIDENCE – East of Allen’s Avenue extending to its terminus at the waterfront. Said parcel is designated at Plat 46, lot 630; 200 Allen’s Avenue, Providence, RI.

Mr. DeSisto introduced City of Providence Council Member of Ward 10, Pedro Espinal, where the ROW was located. Councilman Espinol would represent the City of Providence in this matter. Councilman Espinol expressed his and the City of Providence’s gratitude on the Council’s actions for the Public Street Right of Way.

Mr. DeSisto presented to the Full Council his Public Street ROW report to the ROW Subcommittee as well as the ROW Subcommittee’s written Recommendation for the Public Street ROW.

Acknowledgments were made to and by Greg Schultz, Attorney General’s Office, and David Everett, City of Providence, for their research and tireless efforts to provide the documentation used to support the use of the parcel as a Right of Way to the shore dating back to maps from 1876 as provided by the City of Providence Department of Public Works.

Mr. DeSisto stated that the CRMC ROW Subcommittee held a Public Hearing on the matter with and only favorable comments were heard.

Mr. DeSisto informed the Council that the ROW Subcommittee recommended that the Public Street ROW in the City of Providence be designated as a public ROW to the title waters of the State of RI.

Mr. Gagnon motioned for the Full Council to accept the ROW Subcommittee’s recommendation to make the Public Street Right-of-Way, east of Allen’s Avenue extending to its terminus at the waterfront, a full public Right-of-Way. The motion was seconded by Mr. Gomez.

Motion carried on a unanimous vote to make the Public Street ROW in the City of Providence a CRMC Designated Right-of-Way to the shore.

City Councilman Espinol expressed his gratitude to the Council and the ROW Subcommittee.
