In accordance with notice to members of the RI CRMC Rights-of-Way Subcommittee, a meeting was held on Tuesday, November 28, 2023 at 5:00 p.m. in Conference Room A, of the Administration Building, One Capitol Hill, Providence, RI.

Chair Coia opened the meeting at 5:00 p.m.

1. Approval of the Minutes of the Previous Meeting

Chair Coia called for a motion regarding the ROW Subcommittee Meeting minutes held on Tuesday, August 22, 2023.

Motion to Approve:
Motion: Mr. Gagnon
Second: Ms. Reynolds

Motion carried on unanimous voice vote.

2. Staff Report by Mr. Willis:

No staff report.

3. In the Matter of Spring Avenue Extension CRMC File 2020-11-084

  • Third Revised Proposed Schedule
  • Extension from 10-27-2023 to 12-01-2023 for exchange of expert reports

Parties present:
William Conley, Solicitor for Town of Westerly
Michael Rubin, for Intervenor Caroline Contrata
Joseph Farside, for Weekapaug Fire District
Greg Schultz, Attorney General’s Office

The Attorneys updated the Subcommittee Members regarding the status of their deposition progress and the discovery progress.

The Attorneys updated the Subcommittee Members regarding the request for acceptance of the Third Revised Proposed Schedule stating that they are all abiding by the new timeframes. Discussion was still needed as to whether or not they would make the December 20th deadline for Expert/witness statements/deposition transcripts to CRMC; Joint Statement of Facts to CRMC; Joint Exhibits to CRMC.

Mr. Schultz stated that they had begun their depositions and would start in earnest in December.

Mr. Farside stated that they had 25 witnesses to be deposed and had only deposed one at this time.

In response to Mr. DeSisto, the Attorneys stated that there were no plans at this time to depose Town Officials.

Mr. Farside confirmed for Mr. DeSisto that the Proponents had received the non-redacted lay witness list and that the Proponents agreed to the redactions.

Mr. DeSisto explained that the witness lists were subject to an APRA request and appeals for redactions.

No further questions from Subcommittee.

Mr. Gagnon motioned to approve the revised schedule, with a second from Ms. Reynolds.

Motion carried on a unanimous voice vote.

Mr. Langseth expressed concern with the number of witnesses and asked that the Subcommittee limit the number of witnesses.
