1. Approval of Minutes for January 23, 2024

Motion: Mr. Gagnon motioned to approve the minutes of 01-23-2024.
Second: Mr. Coia seconded the motion.

Motion was carried on unanimous voice vote.

2. Staff Report — None

3. STATUS Updates

Spring Avenue Right of Way -- CRMC File 2020-11-084

Present:
Joseph Farside, Esq., representing Weekapaug Fire District
Michael Rubin, Esq., representing Caroline Contrata
William Connelly, Esq., representing Town of Westerly
Randell Booth, Esq., Attorney General’s Office

All parties involved agree with the Fifth Revised Proposed Schedule. The parties requested from the Subcommittee an additional month to complete all tasks in the last bullet point of the schedule with a firm date of June 15, 2024 to have all required and agreed upon documentation to CRMC.

Mr. DeSisto asked for clarification on the paragraph after the last bullet in the Fifth Revised Proposed Schedule, asking if it had to do with pending litigation.

Mr. Farside stated that he believed that the language of said paragraph would cover the court proceeding.

The parties discussed having a conference to discuss disputed facts amongst themselves and then having Mr. DeSisto and Mr. Hartmann be a party to the discussion.

Mr. DeSisto asked if the June 15th date could be made a Date Certain.

Chair Coia requested a motion to change the May 15th date to June 15th as a Date Certain.

Mr. Gagnon made the motion.

Mr. Coia seconded the motion.

All ayes

Motion carried.

4. Public Comment:

Mr. Langseth expressed appreciation for the opportunity to comment and appreciation that the Proposed Scheduled date of June 15th, 2024 is a Date Certain.

5. Adjournment:

Motion carried on unanimous voice vote.
